By accessing and using Yakaz, you accept to be bound by, and comply with, the Terms and Conditions below, applicable as of 01/02/07. Those Terms and Conditions may be updated from time to time to reflect the modifications brought to the service delivered from this website (the “Service”). As a result, it is your responsibility to review this page periodically in order to gain knowledge of any update, it being specified that any such modification or update shall be automatically binding and enforceable upon their posting on this website. Your continued use of the website shall be deemed acceptance of any change to the applicable Terms and Conditions. Should you disagree with the Terms and Conditions or any subsequent amendment thereof, you must cease to use this website at once.

Description of Services and content of the advertisements

The Service offered by Yakaz consists in searching and displaying the advertisements matching your request by means of an automated search engine, without any interaction or involvement with people. The results provided to you as part of the Service cannot be deemed exhaustive with respect to the range of products or services you are looking for.

It is understood that Yakaz does not monitor the content of the advertisements displayed or of the associated websites and that the role of Yakaz solely consists of automatically selecting the advertisements based on their relevance [through meta tags or key words as included in such advertisements] with regard to your request. Accordingly, Yakaz does not take any responsibility in its capacity as publisher or author of the content of the advertisements included in the results of your request, or of the associated websites and hyperlinks. In this respect, Yakaz does not monitor and does not accept any liability with respect to:

(i) The quality, the fitness for a particular purpose or merchantability of the products and services offered through the selected advertisements ;
(ii) The reliability, the accuracy, the up-to-date nature or the lawfulness of any information related to the products and services offered in the advertisements or to the identification of the advertisers ;

Any fraudulent, lying, deceitful advertisement or any advertisement inducing access to a website with harmful or illegal content can be reported to Yakaz by email.

In any instance, the removal from the results of the reported advertisement or the blocking of the access to the reported website, so far as they are technically feasible, shall depend on Yakaz’s sole judgement and Yakaz shall not be bound to comply with the requests of the users of the Service in any manner whatsoever.

Obligations of the users

By accessing Yakaz’s website, you undertake to use the Service in accordance with its intended purpose and to refrain from:

(a) breaching or tampering with the security or integrity of the website and especially from: (i) engaging in any action which may adversely affect, or interfere with, the proper functioning of the website; (ii) accessing, or attempting to gain access to, data which is not meant or intended to be viewed by the users; or (iii) entering or attempting to enter, a server or an account which users are not allowed to access,

(b) carrying out, without Yakaz’s express authorization, any “framing” operation or creating any “mirror websites” virtually replicating this website,

(c) using information relating to the advertisers for illicit or inappropriate purposes such as unsolicited advertising, sending of junk mail, participation in “chain letters” or in any unauthorised competitions or lotteries or any purpose violating applicable data protection rules, etc.

Intellectual Property Rights

All rights, title and interest in and to the website and the Service, or any components thereof, are the ownership of Yakaz. “Yakaz” is protected by copyright laws and is a registered trademark in France and abroad.

Yakaz contains elements that are its property or the property of persons having granted a license to Yakaz. By accepting these Terms and Conditions, you agree not to copy, reproduce, modify, alter or distribute all or part of the website without the prior express authorization of Yakaz. In this regard, you undertake to indemnify and hold Yakaz harmless (together with its directors and employees) against any third party claim based on the infringement of any intellectual property right, breach of these Terms and Conditions or disregard of any laws and regulations for which you are accountable.

Liability and warranties

For the reasons stated above, Yakaz is not in a position to give any warranty as to the accuracy of the information contained in the advertisements and the associated third party websites or exchanged among users and does not accept any liability or warranty in connection with the products and services offered through the advertisements, in which Yakaz does not take any part.

You acknowledge being aware of the risks and limitations associated with the use of the Internet, and Yakaz shall not be held liable in the event of unavailability of the Service arising from maintenance of the website, or in any event hindering access to the website, in case of improper use of the website, or in case of direct or indirect damages suffered by the user arising from the use of the information obtained through the Service or the data available on the Internet from Yakaz’s crawling service.

Modification of the Service

Yakaz reserves the right to modify the Service and its features at any time and you are not entitled to avail yourself of any right to claim the continued use of the Service and its functions.

Governing law

These Terms and Conditions are governed by the laws of France. Any dispute between a user and Yakaz that cannot be resolved through amicable settlement shall be brought before the competent Courts of Paris, except where such choice of jurisdiction is not enforceable against the user in his/ her capacity as consumer.

Personal data

Yakaz is filed with French Data Protection Authority (CNIL) under # 1131451. Any user can request from Yakaz to be provided with its collected personal data and have them rectified, if need be, in accordance with Law # 78-17, of 6 January 1978.
